1Who is responsible
Responsible for data processing in this shop (controller within the meaning of the GDPR) is trendura, No. 5, 18/F, Strand 49, 49 Bonham Strand Sheung Wan, email help@trendura.co. Further details in our imprint.
2Overview
We process personal data only as far as necessary to run our shop, process your orders and, with your consent, for marketing. Legal bases are in particular Art. 6 (1) (a) GDPR (consent), (b) (contract and pre-contractual steps), (c) (legal obligations, e.g. tax law) and (f) (legitimate interests, e.g. secure operation and improvement of our shop). For access to information on your device, § 25 TDDDG applies.
3Shop system and hosting
Our shop runs on Shopify (Shopify International Ltd., Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, Ireland). Shopify hosts the shop, processes the data you enter at checkout and stores server log files (e.g. IP address, date and time, page visited, browser) for security and stability. Legal basis is Art. 6 (1) (b) and (f) GDPR. Shopify may also process data in Canada and the USA; Canada has an adequacy decision, transfers to the USA are based on the EU-U.S. Data Privacy Framework and/or EU Standard Contractual Clauses. More: shopify.com/legal/privacy.
4Cookies and consent
We use cookies and similar technologies. Technically necessary cookies (e.g. shopping bag, checkout, security, saving your cookie choice) are set on the basis of § 25 (2) TDDDG and Art. 6 (1) (b) and (f) GDPR. Analytics, preference and marketing cookies are only set with your consent (§ 25 (1) TDDDG, Art. 6 (1) (a) GDPR), which you give or refuse in our cookie banner. You can change or withdraw your choice at any time with the button "Cookie settings" at the top of this page.
5Customer account and orders
To process your order we need your name, email address, billing and delivery address, the items ordered and payment information. If you create a customer account, we store your data so you can view orders and start returns; you can delete your account at any time. Legal basis is Art. 6 (1) (b) and (c) GDPR. We use your email address to send order and shipping confirmations.
6Contact
If you contact us by form, email or phone, we process your details (e.g. name, email address, order number, message) to answer your request. Legal basis is Art. 6 (1) (b) GDPR if your request relates to a contract, otherwise Art. 6 (1) (f) GDPR. We delete the data once your request has been dealt with, unless statutory retention periods apply.
7Online withdrawal
If you use the function "Withdraw from contract here", we process your name, email address, order number, the items concerned, the time of submission and any message, to process your withdrawal and confirm receipt. Legal basis is Art. 6 (1) (b) and (c) GDPR.
8Live chat and AI assistant
Our live chat is provided by Shopify Inbox (Shopify, see section 3). Your messages, the name and email address you provide and technical data are processed. During our team hours a member of our team answers. Outside these hours our AI assistant "Vera" answers automatically; it is clearly marked as an AI, and its answers are generated from information about our shop and may be reviewed by our team. Please do not share sensitive data in the chat. Legal basis is Art. 6 (1) (b) GDPR for order questions, otherwise Art. 6 (1) (f) GDPR (fast customer service).
9Order tracking (17TRACK)
On our page "Track my order" you can track your parcel with a widget from 17TRACK (YQTrack Co., Ltd., Shenzhen, China). The widget only loads after you start a search. Your tracking number and technical data (e.g. IP address, browser information) are then transmitted to 17TRACK. Legal basis is your consent by starting the search (Art. 6 (1) (a) GDPR). China has no adequate level of data protection under the GDPR, and authorities may access data there. Alternatively use the tracking link in your shipping email.
10Shipping
To deliver your order we pass your name, delivery address and, where needed for delivery notifications, your email address or phone number to the shipping company. Legal basis is Art. 6 (1) (b) GDPR.
11Payment
Payments are processed by the provider you choose: Shopify Payments (cards, Apple Pay, Google Pay, Shop Pay) with Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Dublin 2, Ireland; PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg; Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden. For "pay later" and instalments Klarna carries out an identity and credit check under its own privacy notice. We pass on the data needed for the payment. Legal basis is Art. 6 (1) (b) GDPR and, for fraud prevention, Art. 6 (1) (f) GDPR.
12Newsletter and emails
If you join the Trendura Club or our newsletter, we use your email address and, if given, your first name to send news on drops, restocks, styling edits and your welcome code. Legal basis is your consent (Art. 6 (1) (a) GDPR). Emails are sent with Shopify Email. With your marketing consent we may also send reminders about items left in your bag or at checkout, products you viewed, a thank-you email after your order and matching suggestions. We measure opens and clicks to improve our emails. You can unsubscribe at any time via the link in every email or by writing to us.
13Creator programme
If you apply as a creator, we process your name, email address, delivery address, TikTok and/or Instagram username, follower numbers, average views and likes, the chosen item and size and your acceptance of our creator terms, to review the application, ship the item and manage the cooperation (Art. 6 (1) (b) GDPR). Declined applications are deleted within 6 months. When you type your TikTok username, your browser asks TikTok (TikTok Technology Limited, 10 Earlsfort Terrace, Dublin 2, Ireland) whether the account exists, and loads your profile picture from the service unavatar.io; both receive the username and your IP address (Art. 6 (1) (b) and (f) GDPR: checking applications, avoiding typing errors and fake accounts).
14TikTok and social media
Some pages show TikTok videos. The TikTok player only loads when you tap a video; only then is data (e.g. IP address, device information) transmitted to TikTok, which may set cookies and shows its own cookie notice (Art. 6 (1) (a) GDPR, § 25 (1) TDDDG). Links to our TikTok and Instagram profiles are plain links; data is only transmitted when you click them.
15Advertising pixels
Only with your consent in the cookie banner (Art. 6 (1) (a) GDPR, § 25 (1) TDDDG) we use the TikTok Pixel (TikTok Technology Limited, see above) and the Meta Pixel (Meta Platforms Ireland Ltd., Merrion Road, Dublin 4, Ireland) to measure the success of our ads and show ads to people interested in our products. Data may be transferred to the USA (EU-U.S. Data Privacy Framework). You can withdraw your consent at any time via "Cookie settings".
16Data in your browser
To make the shop more convenient we store a few settings in your browser's local storage, e.g. the size recommended by our size finder, your language on legal pages, your product grid view and when you closed the newsletter pop-up. This stays on your device, is not sent to us and can be deleted in your browser settings at any time (§ 25 (2) no. 2 TDDDG).
17How long we keep data
We delete personal data as soon as it is no longer needed for the purpose. Order and invoice data are kept for up to 10 years because of commercial and tax retention obligations (§ 147 AO, § 257 HGB). Newsletter data is kept until you unsubscribe.
18Your rights
You have the right to access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and to object to processing based on legitimate interests (Art. 21), as well as to withdraw any consent with effect for the future (Art. 7 (3)). Write to help@trendura.co. You also have the right to lodge a complaint with a supervisory authority, e.g. the Berlin Commissioner for Data Protection and Freedom of Information, Alt-Moabit 59-61, 10555 Berlin.
